General Information

We process personal data only to the extent necessary to provide this website and our content, or where you have given your consent. Personal data means any information relating to an identified or identifiable natural person.
This policy applies to the website https://obscure-interactive.com. Linked third-party websites are the sole responsibility of their operators.

Hosting and Server Log Files

Our website is hosted by:
Droptop GmbH
Am Grashorn 8
14548 Schwielowsee
Germany

When you access our website, the server automatically collects data transmitted by your browser and stores it in server log files:

  • IP address of the requesting device
  • date and time of access
  • name and URL of the file accessed
  • volume of data transferred and notification of successful retrieval
  • browser type and version, operating system
  • referred URL

The legal basis is Article 6(1)(f) GDPR. Our legitimate interest lies in providing our website free of technical errors, optimising it and ensuring its security.

Retention period: The log data is stored for a limited period and deleted as soon as it is no longer required for the purposes described above. Where individual entries are retained for longer in order to investigate security incidents, the IP addresses are truncated or otherwise anonymised beforehand.

We have concluded a data processing agreement pursuant to Article 28 GDPR with our hosting provider.

Contacting Us

If you contact us by email, we process your details to handle your enquiry and any follow-up questions.

The legal basis is Article 6(1)(b) GDPR where the enquiry relates to the initiation or performance of a contract, otherwise Article 6(1)(f) GDPR based on our legitimate interest in responding to enquiries.

We delete the data once it is no longer required for that purpose and no statutory retention obligations apply.

Recipients and Transfers to Third Countries

We disclose personal data only where legally permitted, in particular to technical service providers acting as processors and to bodies to which we are legally obliged to provide information.

Where data is processed outside the European Union, we base the transfer on an adequacy decision of the European Commission or on standard contractual clauses pursuant to Article 46(2)(c) GDPR.

Your Rights

You have the right at any time to:

  • access the data we process about you (Article 15 GDPR)
  • rectification of inaccurate data (Article 16 GDPR)
  • erasure (Article 17 GDPR)
  • restriction of processing (Article 18 GDPR)
  • data portability (Article 20 GDPR)
  • withdraw consent with effect for the future (Article 7(3) GDPR). This does not affect the lawfulness of processing carried out before withdrawal

Right to object: You have the right to object at any time, on grounds relating to your particular situation, to processing of your data based on Article 6(1)(f) GDPR (Article 21 GDPR). Where processing is for direct marketing purposes, you may object at any time without giving reasons.

To exercise these rights, simply send a message to info@obscure-interactive.com.

Right to lodge a complaint: You may lodge a complaint with a data protection supervisory authority, in particular in the Member State of your residence, place of work or the place of the alleged infringement.

Data Security

This website uses SSL/TLS encryption. You can recognise an encrypted connection by ‘https://’ in your browser’s address bar.

Consent Management

We use the consent management service CookieYes to obtain and document your consent to the setting of cookies and comparable technologies. The provider is CookieYes Limited, 3 Warren Yard, Warren Park, Wolverton Mill, Milton Keynes, MK12 5NW, United Kingdom.

When you access our website, the consent banner is loaded from the provider’s servers. In doing so, your IP address is transmitted to the provider. Your consent decision, together with an identifier, the time of consent and technical information about your browser, is stored and logged so that we can demonstrate compliance with our documentation obligations. For this purpose, a cookie is stored on your device which records your consent decision.

The legal basis is Article 6(1)(c) GDPR in conjunction with our obligation under Article 7(1) GDPR to be able to demonstrate consent, and Article 6(1)(f) GDPR. Our legitimate interest lies in the legally compliant management of consent. The storage of and access to the consent cookie is technically necessary within the meaning of Section 25(2) no. 2 TDDDG and therefore does not itself require consent.

Personal data is transferred to the United Kingdom. The European Commission has determined by way of an adequacy decision that the United Kingdom offers an adequate level of protection for personal data, so that no additional safeguard are required for this transfer.

Cookies and Similar Technologies

Our website uses cookies. Cookies are small text files that your browser stores on your device. They cause no damage to your device and contain no viruses.

Technically necessary cookies: We use cookies that are required for the basic functions and the secure operation of this website, for example to store your cookie preferences. These are set without your consent. The legal basis is Section 25(2) no. 2 TDDDG in conjunction with Article 6(1)(f) GDPR. Our legitimate interest lies in the technically errror-free provision of our website.

Cookies requiring consent: Cookies and comparable technologies that are no technically necessary – in particular those set in connection with the embedded content described below – are only used if you have given us your prior consent. The legal basis is Section 25(1) TDDDG in conjunction with Article 6(1)(a) GDPR.

You can withdraw your consent at any time with effect for the future via the cookie settings. The lawfulness of the processing carried out on the basis of your consent up to the point of withdrawal remains unaffected.

You can also configure your browser so that you are informed about the setting of cookies, permit cookies only in individual cases, exclude them generally, and have them deleted automatically when closing the browser. If cookies are disabled, the functionality of this website may be limited.

Fonts

This website uses locally hosted fonts. The font files are stored on our own server and are loaded exclusively from there when you access our website. No connection is established to the servers of a third-party font provider, and in particular no data is transmitted to Google.

Youtube

We embed videos from the YouTube platform on our website. The provider is Google Ireland Limited, Gordon House, Borrow Street, Dublin 4, Ireland (“Google”).

Videos are embedded in YouTube’s extended data protection mode (youtube-nocookie.com). No content is loaded and no connection to Google’s servers is established until you have given your consent and actively started the video. Until then, only a preview image stored on our own server is displayed.

Once you start a video, a connection to Google’s servers is established. Google is thereby informed which of our pages you have visited and receives your IP address. Google may store cookies or comparable technologies on your device and use them to analyse your user behaviour, to improve its services and to display advertising. If you are logged into a YouTube or Google account while doing so, Google can assign your browsing behaviour directly to your personal profile. You can prevent this by logging out of your account before starting a video.

We have no influence on the nature and scope of the data processed by Google, on the further processing of that data or on its disclosure to third parties. Google acts as an independent controller in this respect. Further information can be found in Google’s privacy policy at https://www.policies.google.com/privacy.

The legal basis for loading the videos and for the associated storage of and access to information on your device is your consent pursuant to Article 6(1)(a) GDPR and Section 25(1) TDDDG. You can withdraw your consent at any time with effect for the future via the cookie settings.

In this context, personal data may also be transferred to servers operated by Google LLC in the United States. Google LLC is certified under the EU-U.S. Data Privacy Framework, for which the European Commission adopted an adequacy decision on 10 July 2023. Insofar as the transfer is not covered by that adequacy decision, it takes place on the basis of your express consent pursuant to Article 49(1)(a) GDPR. We would like to point out that, according to the case law of the Court of Justice of the European Union, an adequate level of data protection cannot be guaranteed in the United States in all cases and that access to your data by US authorities cannot be ruled out.

Changes to This Privacy Policy

We update this privacy policy when the legal situation or our processing activities change. The version available on this page applies.
